Article 1 – Definitions

In these terms and conditions, the following definitions apply:

• Entrepreneur: Bella Toys&More, located at Graaf Alarfsingel 80, 6663RA Nijmegen, the Netherlands. Chamber of Commerce number: 93097794, VAT number: NL004998310B03.
• Consumer: The natural person not acting for purposes relating to their trade, business, craft or profession.
• Distance Contract: An agreement concluded between Bella Toys&More and the consumer within the framework of an organized system for distance selling of products, whereby exclusive use is made of one or more means of distance communication.
• Cooling-off Period: The period within which the consumer may exercise their right of withdrawal.
• Right of Withdrawal: The consumer’s right to cancel the distance contract within the cooling-off period.

Article 2 – Applicability

These terms and conditions apply to every offer made by Bella Toys&More and to every distance contract concluded between Bella Toys&More and the consumer.

Article 3 – The Offer

• The offer includes a complete and accurate description of the products offered. This description is sufficiently detailed to enable the consumer to make a proper assessment of the offer.
• Each offer clearly states the rights and obligations attached to acceptance.

Article 4 – The Agreement

• The agreement is concluded at the moment the consumer accepts the offer and complies with the applicable conditions, subject to the provisions of paragraphs 4 to 6.
• If the consumer accepts the offer electronically, Bella Toys&More shall promptly confirm receipt electronically. Until receipt is confirmed, the consumer may cancel the agreement.
• If the agreement is concluded electronically, Bella Toys&More shall implement appropriate technical and organizational measures to secure electronic data transmission and ensure a secure web environment. For electronic payments, suitable security measures shall be observed.
• Bella Toys&More may, within the limits of the law, verify whether the consumer can meet their payment obligations and inquire about other relevant facts for responsibly entering into a distance contract. If, based on this investigation, there are valid reasons not to proceed, Bella Toys&More is entitled to refuse an order or attach special conditions.
• Bella Toys&More reserves the right to cancel orders in cases of clear errors in the offer, such as unrealistic prices or incorrect product information. The consumer will have the right to cancel the agreement free of charge in such cases.
• Before the contract is concluded, these terms and conditions shall be made available electronically in such a way that they can be easily stored on a durable medium. If this is not reasonably possible, Bella Toys&More will indicate how the terms can be viewed electronically and that they will be sent free of charge upon request.

Article 5 – Right of Withdrawal

• The consumer may cancel a product purchase within a 14-day cooling-off period without giving any reason.
• This period starts on the day after the consumer, or a third party designated by the consumer, has received the product.

Article 6 – Obligations of the Consumer During the Cooling-off Period

• During the cooling-off period, the consumer must handle the product and packaging with care. The product may only be unpacked or used to the extent necessary to determine its nature, characteristics, and functioning.

Article 7 – Exercising the Right of Withdrawal and Associated Costs

• If the consumer wishes to exercise their right of withdrawal, they must notify Bella Toys&More within the cooling-off period using the model withdrawal form or by another clear statement.
• The consumer must return the product as soon as possible, and no later than 14 days after the notification mentioned in paragraph 1.
• The consumer bears the direct cost of returning the product.

Article 8 – Obligations of the Entrepreneur in Case of Withdrawal

• Bella Toys & More will reimburse all payments received from the consumer, including any delivery charges, without undue delay and within 14 days after the consumer has notified them of the withdrawal.
• Reimbursement shall be made using the same payment method used by the consumer unless otherwise agreed.

Article 9 – Exclusion of the Right of Withdrawal

The right of withdrawal is excluded for products that:

• Are irreversibly mixed with other items after delivery.
• Have been unsealed after delivery and are not suitable for return due to health protection or hygiene reasons.

Article 10 – Price

• All prices stated for products include VAT.
• Any applicable shipping costs are clearly stated before the agreement is concluded.

Article 11 – Conformity and Additional Warranty

• Bella Toys&More guarantees that the products comply with the contract, the specifications stated in the offer, and reasonable requirements of reliability and usability.
• Any additional warranty offered by Bella Toys&More or third parties shall never affect the legal rights of the consumer.

Article 12 – Delivery and Execution

• Bella Toys&More shall exercise the utmost care in receiving and fulfilling product orders.
• The delivery address is the address provided by the consumer.
• Bella Toys&More delivers to the following EU countries: Belgium, Denmark, Germany, Estonia, Finland, France, Greece, Ireland, Italy, Luxembourg, Malta, Monaco, the Netherlands, Austria, Poland, Portugal, Spain, and Sweden.
• Estimated delivery time is between 1 and 10 business days, depending on the destination country.
• Shipping costs: Orders with shipping costs up to €7 are shipped free of charge. For orders with shipping costs exceeding €7, those costs will be added to the invoice total.

Article 13 – Duration Transactions: Termination and Renewal

• The consumer may cancel an open-ended agreement at any time, subject to a notice period of no more than one month and according to the agreed termination procedures.

Article 14 – Payment

• Unless otherwise specified, amounts owed by the consumer must be paid within 14 days after the start of the cooling-off period.
• The consumer is obliged to promptly report any inaccuracies in provided or stated payment details to Bella Toys&More.

Article 15 – Complaints Procedure

• Bella Toys&More has a sufficiently disclosed complaints procedure and handles complaints according to this procedure.
• Complaints regarding the execution of the agreement must be submitted to Bella Toys&More fully and clearly described within a reasonable period after the consumer has identified the issue.

Article 16 – Disputes

• All agreements between Bella Toys&More and the consumer to which these terms and conditions apply are governed exclusively by Dutch law.
• Disputes regarding the formation or performance of such agreements may be submitted by either party to the Webshop Disputes Committee.

Article 17 – Additional or Diverging Provisions

Additional or deviating provisions may not be to the consumer's disadvantage and must be recorded in writing or made available in such a way that the consumer can store them on a durable medium.
